Welcome to FOTEPUR (“the Website,” “we,” “us,” or “our”). By accessing https://fotepur.com/ or using any of our services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please discontinue use immediately.

1. Our Services

FOTEPUR provides three main types of services:

• Online Courses: Self‑paced or scheduled learning programmes created by FOTEPUR or authorised instructors.
• Books & Materials: Digital downloads (e‑books, PDFs, templates) and, where applicable, physical books.
• Marketplace: A venue where independent sellers (“Sellers”) list their own products. FOTEPUR is not a party to any marketplace sale contract and does not guarantee items sold by Sellers.

2. Account Registration

You must be at least 16 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for maintaining the confidentiality of your password and for all activities under your account. We may suspend or terminate accounts that provide false information or violate these Terms.

3. Course & Material Access

3.1 Licence

Purchasing a course or material grants you a limited, non‑exclusive, non‑transferable, revocable licence to access the content for your personal, non‑commercial educational use. You may not reproduce, distribute, or publicly display any part of the content without our written permission.

3.2 Availability & Discontinuation

We strive to keep courses available for the period stated at the time of purchase. If a course is permanently discontinued before you have completed it, you will be entitled to a pro‑rata refund based on the unaccessed portion of the course (calculated on a per‑module basis). We are under no obligation to maintain a course indefinitely.

4. Payments & Refunds

4.1 Pricing & Currency

All prices are shown in [Your Currency, e.g., Bangladeshi Taka (BDT)] and include/exclude applicable taxes as indicated at checkout. We accept [list payment methods, e.g., bKash, Nagad, credit/debit cards].

4.2 Course Refunds

You may request a full refund within [7/14] days of purchase if you have completed less than [25%] of the course content. After that window, or if substantial progress has been made, refunds are not available except where required by applicable law.

4.3 Digital Materials

Due to the immediate access nature of digital goods, refunds for downloadable materials are generally not offered once the download has started. Please review the product description before purchase.

4.4 Physical Goods & Marketplace

Refunds and returns for marketplace purchases are governed solely by the Seller’s policy. FOTEPUR is not involved in the transaction and does not provide refunds on behalf of Sellers.

5. Intellectual Property

All content on the Website – including text, graphics, logos, videos, course materials, and the platform itself – is owned by FOTEPUR or its licensors and is protected by copyright and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

6. User Conduct

You agree not to:

• Use the Website for any unlawful purpose.
• Upload or transmit any content that is defamatory, obscene, harassing, or otherwise objectionable.
• Attempt to bypass security features or access non‑public areas of the platform.
• Use any automated means (scrapers, bots) to collect data without prior written permission.
• Resell, redistribute, or share your account or course access with others.

7. Marketplace – Important Notice

The Marketplace is merely a venue that connects buyers with independent Sellers. FOTEPUR does not control, endorse, or guarantee the quality, safety, legality, or delivery of any goods listed by Sellers. Any dispute between a buyer and a Seller must be resolved directly between them. FOTEPUR assumes no liability arising from any marketplace transaction.

8. Disclaimer of Warranties

THE WEBSITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOTEPUR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of Bangladesh. Any dispute shall first be attempted to be resolved through informal negotiation. If unresolved within 30 days, the dispute shall be finally settled by binding arbitration in accordance with the Arbitration Act, 2001 of Bangladesh, conducted in [City, e.g., Dhaka], in [Bengali/English]. Either party may seek injunctive relief from a court of competent jurisdiction to prevent irreparable harm.
